The case involves a wrongful-death suit brought by Alison Miller and Todd Parrish against a Chicago fertility clinic. Workers at the clinic inadvertently discarded the couple's frozen embryo in 2000.
The judge cited an Illinois law that allows mothers to sue if their unborn baby is harmed.
